These Terms of Service (“Terms”) govern your use of NetChefs Daily (“Daily”) — our website, waitlist, members portal, and weekly private-chef meal service. By using Daily or submitting your information, you agree to these Terms. Daily is offered by NetChefs and is separate from one-time private event services on netchefs.net unless we tell you otherwise in writing.
1. Service description
Daily provides recurring, chef-prepared meals for households in eligible cities. Availability, menus, delivery or pickup windows, and pricing depend on your plan and location. Joining the waitlist or submitting a signup request does not guarantee acceptance or immediate service.
2. Eligibility and accounts
You must provide accurate contact information. Members portal access is provisioned by Daily after acceptance. You are responsible for activity under your account and for keeping login codes confidential. Notify us promptly of unauthorized access.
3. Plans, billing, and changes
Plan details, pricing, and billing frequency will be confirmed before service begins. Fees are generally non-refundable once a production week has started, except where required by law or expressly stated in your member agreement. We may adjust menus for seasonality, supply, or chef availability with reasonable notice when practicable.
4. Food, allergies, and safety
You must disclose allergies, restrictions, and health-related dietary needs accurately and promptly. While we and our chefs take care in preparation, we cannot guarantee environments free of all allergens. You are responsible for determining whether meals are suitable for you and your household.
5. Cancellations and pauses
Pause, skip, and cancellation rules will be communicated in your member onboarding materials. Unless otherwise stated, requests must be submitted before the cutoff for the relevant delivery week. We may suspend service for non-payment, unsafe conduct, or repeated missed communications.
6. Acceptable use
You agree not to:
- Misuse the website, portal, or support channels;
- Submit false information or impersonate others;
- Interfere with Daily operations or attempt unauthorized access;
- Use Daily for unlawful purposes.
7. Intellectual property
Daily branding, website content, menus, photography, and materials are owned by NetChefs or its licensors. You may not copy, scrape, or redistribute them without permission.
8. Disclaimers
Daily is provided “as is” to the fullest extent permitted by law. We disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement where allowed.
9. Limitation of liability
To the maximum extent permitted by law, NetChefs and its affiliates are not liable for indirect, incidental, special, consequential, or punitive damages, or for amounts exceeding the fees you paid Daily in the three months before the claim arose, except where liability cannot be limited by law.
10. Disputes
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules, except where mandatory consumer protections in your jurisdiction apply. Disputes should first be raised with us through support channels so we can try to resolve them informally.
11. Changes
We may update these Terms by posting a revised version on this page. Material changes to active memberships will be communicated when reasonable. Continued use after the effective date constitutes acceptance.
